1. General
These Terms and Conditions govern participation in all giveaways and membership
services offered by Legacy Rewards Club (ABN: 87 982 051 576), operated by
Odhrán McGarry, a sole trader based at 44/8 Ben Dalley Drive, Helensvale, Gold
Coast QLD 4212.
By purchasing a membership or entering any giveaway conducted by Legacy
Rewards Club, you agree to be bound by these Terms and Conditions. These terms
form part of any entry into a promotion, and participation constitutes acceptance.
2. Eligibility
2.1. Giveaways are open to Australian residents aged 18 years or over, unless
otherwise stated on the specific giveaway listing.
2.2. Employees, contractors, and immediate family members of Legacy Rewards
Club and any associated agencies are ineligible to enter. Immediate family means
any of the following: spouse, ex-spouse, de-facto spouse, child, step-child, parent,
step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother,
sister, step-brother, or step-sister.
2.3. Entrants must have a valid Australian residential address to be eligible to claim
a prize.
2.4. The Promoter reserves the right to verify the eligibility of any entrant and to
disqualify any entrant who does not meet these requirements.
3. How to Enter
3.1. To enter a giveaway, individuals must purchase a membership or entry product
from legacyrewardsclub.com during the applicable promotional period.
3.2. Entry is only valid upon successful completion of payment. Incomplete
transactions will not be counted as valid entries.
3.3. Each eligible purchase entitles the entrant to one (1) entry into the current
active giveaway, unless otherwise specified.
3.4. Multiple entries are permitted, subject to one (1) entry per eligible purchase.
3.5. Entries must be submitted in accordance with the entry requirements set out on
the website at the time of purchase.
4. Entry Allocation and Draw Process
4.1. Entry numbers are allocated randomly to eligible entrants after the promotional
period closes or once the maximum entry cap has been reached, whichever occurs
first.
4.2. A Final Entry List will be published on legacyrewardsclub.com prior to each
draw. The list will include each entrant's first name and order reference number
alongside their allocated entry number(s).
4.3. All draws will be conducted live on Legacy Rewards Club's Facebook page to
ensure full transparency and fairness.
4.4. The Promoter may draw reserve entries in order, in the event that a winning
entry is deemed invalid or the winner is ineligible.
4.5. If a giveaway reaches its maximum entry cap before the advertised close date,
the draw will be brought forward accordingly.
4.6. The Promoter's decision in relation to all aspects of the draw is final, and no
correspondence will be entered into.
5. Prizes
5.1. Prizes are as described on the relevant giveaway listing at the time of entry.
The Promoter reserves the right to substitute a prize of equal or greater value if the
advertised prize becomes unavailable.
5.2. Prizes are not transferable, exchangeable, or redeemable for cash, unless
otherwise stated.
5.3. If a winner does not claim their prize within the timeframe specified by the
Promoter following notification, the prize will be forfeited.
5.4. The winner is responsible for all costs associated with accepting and using the
prize, including but not limited to applicable taxes, registration, insurance, and
transport, unless otherwise stated.
5.5. Total prize values are as advertised on each specific giveaway listing.
6. Winner Notification
6.1. The winner will be notified via email within two (2) business days of the draw,
using the contact details provided at the time of entry.
6.2. Winners' names will be published on legacyrewardsclub.com and announced
on Legacy Rewards Club's social media channels following the draw.
6.3. By entering, entrants consent to the use of their name, likeness, and general
location for promotional purposes, including announcement of the winner on social
media, without additional remuneration.
7. Unclaimed Prizes
If a prize remains unclaimed after thirty (30) days from the date of winner notification,
the Promoter reserves the right to conduct a re-draw for that prize, subject to any
applicable regulatory requirements.
8. Membership and Rewards Lounge
8.1. Purchase of a membership or entry product may grant access to the Legacy
Rewards Club Rewards Lounge, which includes exclusive partner offers, discounts,
and member rewards.
8.2. Partner offers within the Rewards Lounge are subject to the terms and
conditions of the relevant third-party partner and may be withdrawn or amended at
any time.
8.3. Legacy Rewards Club does not warrant the ongoing availability of any specific
Rewards Lounge benefit and accepts no liability for changes to partner offers.
9. Limitation of Liability
9.1. To the fullest extent permitted by law, the Promoter excludes all liability for any
loss, damage, or injury arising out of participation in a giveaway or use of a prize.
9.2. Nothing in these Terms and Conditions limits, excludes, or modifies any
statutory consumer guarantees provided under the Australian Consumer Law or any
other applicable legislation.
9.3. The Promoter is not responsible for any technical difficulties, unauthorised
access, or issues beyond its reasonable control that may affect the conduct of a
giveaway.
10. Promoter Rights
10.1. The Promoter reserves the right to verify all entries and entrants, including
identity, age, and place of residence.
10.2. The Promoter may disqualify any entrant who breaches these Terms and
Conditions, tampers with the entry process, or engages in fraudulent or improper
conduct.
10.3. The Promoter reserves the right to modify, suspend, or cancel a giveaway
where circumstances beyond its reasonable control make it necessary to do so.
10.4. Incomplete, indecipherable, or illegible entries will be deemed invalid.
11. Governing Law
These Terms and Conditions are governed by the laws of Queensland, Australia.
Any disputes arising out of or in connection with these Terms and Conditions will be
subject to the exclusive jurisdiction of the courts of Queensland.
